NOTICE OF PUBLIC HEARING
The Board of Commissioners of Flathead County, Montana, hereby gives notice, pursuant to Section 76-2-205(1), M.C.A., that it will hold a public hearing to consider a request from the Middle Canyon Land Use Advisory Committee to amend the text of the Canyon Area Land Use Regulatory System (CALURS).
The proposed text amendment would amend the text of Sections 1.6 Applicability, 2.7 Citizens Review Panel, 2.10 Enforcement, 3.3(B)(3)(d) Step 3 Public Review, 3.3(B)(4) Step 4 Decision on Land Use Change, 6.1(A) Upper Canyon Region Exempted Uses, 6.2(A & B) Middle Canyon Region Exempted Uses and Minor Land Uses provisions and Section 7.13 Guest Cabin, 7.14 Gust Cottage, 7.31 Short-Term Rental Housing and 7.33 Single Family Dwelling definitions of the Canyon Area Land Use Regulatory System.
The proposed amendment would also add Sections 4.1 General Performance Standards and Section 4.2 Project Specific Performance Standards to Chapter 4 and renumber Chapter 4 Sections (A – F) to Section 4.1(A - F) and Chapter 4 Sections (G - J) to Sections 4.2 (A – D). The proposed text amendment would amend Chapter 4 Section (C)(2) [proposed Section 4.1(C)(2)] Sanitation, Chapter 4 Section (I) [proposed Section 4.2(C)] Short-term Rental Housing, and Chapter 4(J), [proposed Section 4.2(D)] Work Camp.
The Canyon Area Land Use Regulatory applies to the Middle Canyon area as defined in CALURS and created under Section 76-2-205, M.C.A. Those standards are on file for public inspection at the Office of the Board of Commissioners, located at 800 South Main, Room 302, the Flathead County Planning and Zoning Office, 40 11th Street West, Suite 220, Kalispell, Montana and on the Flathead County Planning and Zoning Office’s website at: http://flathead.mt.gov/planning_zoning/downloads.php. Documents related to the proposed amendments to the regulations are on file for public inspection at the Office of the Board of Commissioners and Recorder and at the Flathead County Planning and Zoning Office.

The public hearing will be held on the 4th day of March, 2025 at 10:30 a.m. in the Commissioners’ Chambers, Third Floor, Old Courthouse, Kalispell, Montana. At the public hearing, the Board of Commissioners will give the public an opportunity to be heard regarding the proposed change to the text of the Flathead County Zoning Regulations.
Written comments are encouraged and will be reviewed by the Commissioners prior to the hearing if received by the Flathead County Commissioners’ Office at least three business days prior to the hearing.
