NOTICE OF PUBLIC HEARING
The Board of Commissioners of Flathead County, Montana, hereby gives notice, pursuant to Section 76-2-205(1), M.C.A., that it will hold a public hearing to consider a change in the zoning designation in a portion of the Evergreen Zoning District from R-1 (Suburban Residential) to B-2 (General Business) for property located at 107 and 113 W Cottonwood Drive, Kalispell, MT 59901.
The boundary of the area proposed to be amended from R-1 (Suburban Residential) to B-2 (General Business) are described as:
A tract of land in the SW¼SW¼ of Section 4, Township 28 North, Range 21 West, M.P.M., Flathead County Montana; described as follows;
Commencing at the Northeast Corner of said SW¼SW¼; thence along the North Line thereof
South 89°45’19” West a distance of 30 feet of a point on the East line of that tract described in Warranty Deed recorded June 9, 1956 in Book 391, page 110, records Flathead County, Montana; thence along the East Line of said tract
South 10°55’21” West a distance of 154.63 feet to the point of beginning of the tract to be described; thence continuing along the East line of said Tract
South 00°15’52” East a distance of 270.67 feet to the Southeast Corner of said tract; thence along the Southerly line of said tract
West a distance of 483.51 feet to the Southwest Corner of said Tract; thence along the Westerly Line of said tract
North a distance of 270.66 feet to a point; thence
East a distance of 482.26 feet to the point of beginning.
EXCEPTING THEREFROM: Public Roads and Rights of Way
AND
A tract of land in the Southwest Quarter of the Southwest Quarter of Section 4, Township 28 North, Range 21 West, described as follows;
Beginning at a point 30 feet West of and 422.5 feet South of the Northeast corner of said Southwest Quarter of the Southwest Quarter; thence
West 610 feet; thence
South 300 feet; thence
East 610 feet; thence
North 300 feet to the place of beginning
The regulations defining the R-1 and B-2 zones are contained in the Flathead County Zoning Regulations on file for public inspection at the Office of the Board of Commissioners, 800 South Main, Room 302, Kalispell, Montana, at the Flathead County Planning and Zoning Office, 40 11th Street West, Kalispell, Montana, and on the Flathead County Planning and Zoning Office’s website at: http://flathead.mt.gov/planning_zoning/ downloads.php. Documents related to the proposed zone change are also on file for public inspection at the Commissioners’ Office and at the Flathead County Planning and Zoning Office.
The public hearing will be held on the 13th day of May, 2024 at 10:45 a.m. in the Commissioners’ Chambers, Third Floor, Courthouse, Kalispell, Montana. At the public hearing, the Board of Commissioners will give the public an opportunity to be heard regarding the proposed change to the Evergreen Zoning District.
Written comments are encouraged and will be reviewed by the Commissioners if received prior to the hearing.
